Is should be purely &#8220;NO&#8221; since the USPTO does not allow the inventor to &#8220;SWEAR&#8221; behind a reference under AIA. &#8220;SWEAR&#8221; is a term of art referring to Rule 131 affidavits, which the AIA got rid of.</p>
