i think the restriction requirement can be issued anytime during the prosecution of an application until it is closed, but usually is issued before the 1st OA. but as long as the applicant’s claim amendments introduce this issue, the RR can be triggered by this issue.

the following question is from real question 2003 October AM

my question is 2nd application was filed on Dec 16, 2002, which is not within 12 months of filing date Dec 13, 2001 of 1st application, so it should loss the benefit of the priority of 1st application, what do u guys think about it?

if a prior art is a US patent application by another which was filed and published before the effective filing date of the claimed invention, can the claimed invention be rejected either under 102a(1) or 102a(2) using this prior art?

how will the exminer choose the statutory bar btw 102a(1) and 102a(2) in above secnario?
