Final Rejection — When & How

A final rejection closes prosecution on the merits. After a final rejection, applicant's options are limited under MPEP § 706.07.

High-Yield RuleA final rejection may only be made after the first Office Action on the merits when the application contains claims previously pending in another application rejected on the same grounds.

Common exam question types test whether you can identify which responses are available after final rejection — RCE, Notice of Appeal, or after-final amendments under 37 C.F.R. § 1.116.
