2141 Examination Guidelines for Determining Obviousness

 

The following guidelines establish the policies and procedures for Office personnel in evaluating whether a claimed invention would have been obvious under 35 U.S.C. 103.

 

2141.01 Scope and Content of the Prior Art

Prior art that may be applied under 35 U.S.C. 103 includes patents and printed publications in this and foreign countries as well as other prior art described in 35 U.S.C. 102.

 

2141.02 Differences Between the Claimed Invention and the Prior Art

All claim limitations must be considered and given appropriate weight when determining the differences between the claimed invention and the prior art.

 

2141.03 Level of Ordinary Skill in the Art

The level of skill in the pertinent art is a factual question, and must be resolved on a case-by-case basis. Factors that may be considered include the educational level of active workers in the field, the types of problems encountered in the art, prior art solutions to those problems, rapidity with which innovations are made, and sophistication of the technology.
